User Code of Conduct
1. Scope
This M3 Experts User Code of Conduct (“Code”) applies to participation in and use of all sites, software, applications, content, products and services (“Services”) offered by M3 Experts or its affiliates (“M3 Experts”, “we”, “us” or “our”). Capitalized terms used below but not defined in this Code have the meaning set forth in the Master Use Agreement (“MUA”).
2. Introduction
Participants in and consumers of M3 Experts Services (“Users”, “you” or “your”) are expected to always conduct themselves in a professional and ethical manner. This includes treating other Users with respect, protecting other Users’ privacy and confidentiality, representing capabilities and qualifications in a truthful manner, and refraining from illegal or unethical behavior. This Code of Conduct outlines these principles and practices in greater detail. Violating the Code of Conduct can result in action against your account or content. These policies apply to all Users. Depending on the severity of violation, we may limit the visibility of certain content or remove it entirely. Repeated or egregious offenses will result in account restriction or termination.
3. Changes to Code
M3 Experts may change this Code by posting an updated version of the Code at www.M3Experts.com and such updates will be effective upon posting. Your access of the Services following the posting of changes to this Code means you agree to abide by those changes.
4. Violations
Violation of this Code will be considered a material breach of the MUA and/or other agreement governing use of or participation in the Services.
5. Prohibited Material
A. Users may not, and may not allow any third party to, use Services to display, store, process, or transmit, or permit use of Services to display, store, process, or transmit:
i. Material that infringes or misappropriates a third party’s intellectual property or proprietary rights;
ii. Hate-related or violent material, and/or material advocating discrimination against individuals or groups;
iii. Obscene, excessively profane, or otherwise objectionable material;
iv. Material advocating or advancing criminal hacking, cracking, or phishing;
v. Material advocating or advancing criminal prostitution, pornography, or human trafficking;
vi. Malicious material;
vii. Unlawful software;
viii. Malicious code, such as viruses, worms, time bombs, Trojan horses, and other harmful or malicious files, scripts, agents, or programs;
ix. Material that violates, encourages, or furthers conduct that would violate any applicable laws, including any criminal laws, or any third-party rights, including publicity or privacy rights;
x. Material that is false or misleading, or that does not constitute a user’s original work; or
xi. Any material that does not adhere to generally accepted standards of professionalism.
6. Prohibited Actions
A. Users may not use a service nor allow any third party to use a service to:
i. Generate or facilitate unsolicited commercial email (spam). Such prohibited activity includes, but is not limited to:
a. Sending communications or email in violation of the CAN-SPAM Act or any other applicable anti-spam law or regulation;
b. Imitating or impersonating M3 Experts, another person, or his, her, or its email address, or creating false accounts for the purpose of sending spam;
c. Mining data or harvesting any web property (including any External-Facing Service) to find email addresses or other user account information;
d. Sending unauthorized mail via open, third-party servers;
e. Sending email to Users who have requested to be removed from a mailing list; or
f. Selling to, exchanging with, sharing with, or distributing to a third party personal information, including the email addresses of any person without such person’s knowing and continued consent to such disclosure.
ii. Send, upload, distribute, or disseminate, or offer to do the same, with respect to unlawful, defamatory, harassing, abusive, fraudulent, infringing, obscene, excessively profane, hateful, violent, or otherwise objectionable material, or promote, support, or facilitate unlawful, hateful, discriminatory, or violent causes;
iii. Intentionally distribute viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other items of a destructive or deceptive nature;
iv. Conduct or forward multi-level marketing, such as pyramid schemes and the like;
v. Create multiple accounts, false accounts, or accounts for individuals under the age of 18;
vi. Submit false, misleading, or plagiarized content;
vii. Involve other individuals or entities who are not registered M3 Experts Users in M3 Experts consulting interactions;
viii. Hire out, outsource, or subcontract consulting work via M3 Experts to any third party without M3 Experts’s prior written consent;
ix. Generate or facilitate SMS, MMS, or other text messages or push notifications in violation of the Telephone Consumer Protection Act, the Do-Not-Call Implementation Act, or any other applicable law including anti-spam, telemarketing, or telephone consumer protection laws or regulations;
x. Use the Services in any manner that violates any applicable industry standards, third-party policies, rules and principles of specific professions (such as medical, legal, financial, or human resources), or requirements that M3 Experts may communicate to its Users, including all of the applicable guidelines published by the Insights Association, or any other generally accepted industry associations, carrier guidelines, or other industry standards;
xi. Transmit material that may be harmful to minors;
xii. Illegally transmit, obtain, or seek to obtain another’s intellectual property or other proprietary information without such owner’s or licensor’s permission;
xiii. Impersonate another person, entity, or M3 Experts (via the use of an email address or otherwise) or otherwise misrepresent themselves or the source of any communication;
xiv. Violate the rights (such as rights of privacy or publicity) of others;
xv. Promote, facilitate, or encourage illegal activity;
xvi. Intentionally or unintentionally interfere with the availability of the service for other Users;
xvii. Engage in activity in connection with illegal peer-to-peer file sharing;
xviii. Engage in or promote gambling, or run a gambling operation;
xix. Engage in or solicit prostitution, pornography, or human trafficking;
xx. “Mine” bitcoins and other cryptocurrencies;
xxi. Sell, distribute, or export illegal or prescription drugs or other controlled substances or paraphernalia;
xxii. Operate an “open proxy” or any other form of Internet proxy service that is capable of forwarding requests to any end user or third-party-supplied Internet host;
xxiii. Perform significant load or security testing without first obtaining M3 Experts’s written consent;
xxiv. Remove any copyright, trademark, or other proprietary rights notices contained in or on the service or reformat or frame any portion of the web pages that are part of the service’s administration display;
xxv. Access a third-party web property for the purposes of web scraping, web crawling, web monitoring, or other similar activity through a web client that does not take commercially reasonable efforts to identify itself via a unique User Agent string describing the purpose of the web client and obey the robots exclusion standard (also known as the robots.txt standard), including the crawl-delay directive;
xxvi. Use a service in any manner that would disparage M3 Experts;
xxvii. Use an automated system or bot, to communicate with any third party without clearly communicating that the individual is speaking with a bot;
xxviii. Use any product that incorporates artificial intelligence to respond to questions, including application screening and Survey questions, or for any other purpose unless specifically instructed to do so by M3 Experts;
7. Reporting Violations
Users are required to report any and all violations of this Code of Conduct in a timely manner as follows:
